Termination of Trust
About termination

Termination of the Trust can be stipulated in the Trust deed, but is not mandatory. It can be specified as a specific date as well as occurrence of a specific event, like, death or birth of a specific person, graduation from college, marriage etc. Trusts whose termination is not specified in the Trust deed will be terminated according to the provisions of law.

There is no maximum restriction on the duration of Cyprus trusts unless otherwise provided for in the terms of the trust.

Revocability
About revocability

Revocation is the reserved power of the Settlor to cancel the trust and in such a case the trust assets be returned to him. By clear provision in the Cyprus International Trusts Law an international trust is deemed irrevocable. The trust may be revoked only if it is clearly stipulated so in the trust deed (which is not prohibited).

A Settlor's right to revoke the trust may raise complications in that it may be easier to attack and classify as “sham” and consequently null and void. The property of a revocable trust may also be targeted and claimed by the Settlor's creditors, which would not be possible in case of a irrevocable trust.

Trustees are under a legal obligation to exercise a fiduciary duty of care and maintain the Trust property for the benefit of the Beneficiaries. Trustees are legally precluded from using the Trust assets for their own ends. All the duties and powers of the Trustees are well regulated in Cyprus legislation.

About Trust Management

Income under the Trust is usually distributed to the beneficiaries according to the instructions of the Trust Deed. Cyprus legislation also permits the possibility to accumulate the income of the Trust, adding it to the Trust capital. It can then be used for reinvestment or other purposes and distributed later or upon termination of the Trust.

About Protector

The protector is not a mandatory party to a trust, but may be chosen by the settlor. The function of the protector is to supervise the trustee, thus providing additional assurances to the settlor that the trust assets are properly managed. In extreme circumstances, the protector may remove or replace the trustee.

About Accountant

Appointing an accountant is not mandatory for Cyprus Trust, however for someone that has valuable assets under the trust it is highly recommended to keep accounting records and audited financial statements. Fidesta offers these services, but you can also choose to appoint your own accountant.

Investment Advisor
About Investment Advisor

Appointing an Investment Advisor is not mandatory for establishing Trust, but to ensure that trust assets are most prudently utilized, you can appoint an Investment Advisor who will see to the investments of the trust assets. Fidesta does not provide investment advisory services, therefore if you choose to appoint an Investment Advisor for the Trust, you will have to provide an Investment Advisor on your part.

Legal Advisor
About Legal Advisor

Appointing a Legal Advisor is not mandatory for Cyprus Trust, but for your own security and peace of mind you can appoint a Legal Advisor who will see to the legal matters of the trust and its assets.

Fidesta does not provide legal services, therefore, if you choose to appoint a Legal Advisor for the trust, you will have to provide a Legal Advisor on your part.

  6. Production, distribution or marketing of drugs and other restricted substances, including cannabinoids and substances designed to mimic illegal drugs
  7. Production or distribution of replicas, counterfeit consumer products and any other products or services that directly infringe trademark, patent, copyright, proprietary, or privacy rights of any third party
  8. Fake references, ID and other document falsification services
  9. Shell banks and financial services without independent infrastructure
  10. Financial services attempting to evade or bypass licensing, including unregulated loan, pawnbroker, money remittance and foreign exchange businesses
  11. Production or distribution of lethal military technology, arms or ammunition, including weapon components and kits, explosives, fireworks, cold weapons and weapon replicas
  12. Pyramid financial schemes and multi-level marketing schemes without a valuable physical product
  13. Businesses that offer "get rich quick" schemes, make outrageous claims, use unrealistic incentives or rewards, deceptive or fake testimonials to mislead consumers

  15. Money laundering, terrorist financing or other illegal activities
  16. Any other business that we consider deceptive, predatory or fraudulent
  17. Business structures that make it impossible to identify the ultimate beneficial owners
